Let’s get to grips with the legal essentials for a valid marriage in South Africa. As a wedding celebrant, I specialise in creating heartfelt, personalised ceremonies that reflect you. But here’s the key: while I help bring the joy, laughter, and meaning to your day, the legal registration of your marriage must be done by a registered Marriage Officer. Think of it as two parts of the journey:

•             The Legal Bit: Signing your marriage into law.

•             The Celebration: The ceremony where you declare your love in front of family and friends.

I handle the celebration. For the legal bit, here’s what you need to know:

Legal Requirements for a Valid Marriage in South Africa

  • Both partners must be 18 years or older.
  • You need a registered Marriage Officer (from Home Affairs, a religious institution, or an authorised independent marriage officer).
  • You must provide the following:
    • South African IDs.
    •  If one of you isn’t South African: You’ll need a few extra bits like a Letter of No Impediment and a valid passport/visa.
    • Two witnesses with IDs.
    • Three ID-sized photos of each partner.
    • Divorce decree or death certificate if previously married.
  • Decision on your marital property regime (In Community of Property by default, or Out of Community with an Antenuptial Contract signed before the wedding).

The “ANC” Talk

Before the big day, you’ll need to decide on your marriage contract. In South Africa, if you don’t sign an Antenuptial Contract (ANC) before you say your vows, you are automatically married In Community of Property (everything you own (and owe) is shared equally between you as a couple).

Most couples today opt for an ANC (with or without accrual) to keep their financial lives clear and protected.

I bring a legal background to the table, so feel free to chat to me about the essentials of your marriage contract. For complex contracts, I’ll always recommend you consult a lawyer to ensure everything is watertight.

It’s best to get the marriage contract out of the way early so you can tick it off your list and get back to the fun stuff, like cake tasting!

Where to Do the Civil Ceremony

Couples can complete the legal registration at:

•             Department of Home Affairs offices (nationwide).

•             Approved venues if you book a registered Marriage Officer to come to you.

Many couples choose to do a quick civil ceremony at Home Affairs to “get the paperwork done,” then celebrate with a personalised ceremony led by a celebrant.

How I Fit In

I’m not here to shuffle papers — I’m here to make your vows unforgettable. Once you’ve ticked off the legal requirements, we’ll craft a ceremony that reflects your story, values, and dreams. Whether it’s barefoot on the beach, under a vineyard pergola, in the bush, or in your own backyard, I’ll make sure your “I do” feels like you.
